By checking here and applying for a loan with Payment 1 Financial, you agree that we may try to contact you at any mailing address, e-mail address, or phone number you give us, as the law allows. We may try to contact you in writing (including mail, e-mail, and SMS text messages) and by phone (including the use of prerecorded or artificial voice messages and automatic telephone dialing systems). You agree to notify Payment 1 Financial if any telephone number you have provided is surrendered or changed by you. You are the subscriber and/or customary user of any telephone number(s) you give us. Our calls, texts, and communications to you may be for (1) information regarding your account, such as application procedures, amount due, payment reminders, past due notices, and debt collection, or (2) information regarding promotional offers or cash available for account refinancing. You agree to receive an unlimited number of these SMS text messages per month. You may be charged fees by your cell phone provider for receiving SMS text messages (as rates may apply). You can revoke your consent to receive SMS texts messages or calls using prerecorded or artificial voice messages or automatic telephone dialing systems at any cell phone number you give at any time, by texting “STOP” to any text message or by contacting us at support@payment1.com or 512-394-5192. Your consent to receive such texts or calls is not a condition for the purchase of goods or services from Payment 1 Financial.
CONSENT TO RECEIVE ELECTRONIC DOCUMENTS
Please read this information carefully and, for future reference, either print a copy of this document or retain this information electronically.
INTRODUCTION. You are submitting a credit application to payment1.com. We can give you the benefits of our online service only if you consent to use and accept electronic signatures, electronic records, and electronic disclosures in connection with this transaction (your "Consent"). By completing and submitting an online credit application (your "Application"), you acknowledge that you have received this document and have consented to the use of electronic signatures, electronic records, and electronic disclosures in connection with this transaction (collectively "Records").
ELECTRONIC COMMUNICATIONS. You may request a paper copy of any Record by e-mailing payment1.com at: support@payment1.com . You may request a paper copy even if you withdraw your Consent. payment1.com will retain the Records as required by law and will provide you a paper copy of any Record at no charge.
CONSENTING TO DO BUSINESS ELECTRONICALLY. Before giving your Consent, you should consider whether you have the required hardware and software capabilities described below.
SCOPE OF CONSENT. Your Consent and our agreement to conduct this transaction electronically only apply to this loan transaction. If we receive your Consent, then we will conduct this transaction with you electronically.
HARDWARE AND SOFTWARE REQUIREMENTS. To access and retain the Records electronically, you will need to use the following computer software and hardware: An IBM or MAC compatible computer with Internet access and an Internet Browser that meets the following minimum requirements: Mozilla Firefox 1.5 or later versions or Microsoft Internet Explorer 5.01 or later versions. Also, the specific Internet Browser must support at least 128 bit encryption. To read some documents, you will need a PDF file reader like Adobe Acrobat Reader. If at any time during this transaction these requirements change in a way that creates a material risk that you may not be able to receive Records electronically, payment1.com will notify you of these changes.
WITHDRAWING CONSENT. You may withdraw your Consent at any time and at no charge to you. If you withdraw your Consent prior to receiving the credit transaction, then your withdrawal will prevent you from obtaining an online credit transaction (i.e., a credit transaction obtained over the Internet). To withdraw your Consent, you must e-mail us at: support@payment1.com . Note, however, that the withdrawal of your Consent will not affect the legal effectiveness, validity, or enforceability of the credit transaction you consummated or of any Records that you received electronically prior to such withdrawal (including but not limited to the Promissory Note, any Security Agreement, Arbitration Agreement and the Notice-of-Grievance Agreement, each set forth in the Records).
Credit pull authorization
Fair Credit Reporting Act Notice: You understand that by submitting an application for a loan or clicking on the “I AGREE” button immediately following this notice, you are providing “written instructions” to Payment 1 Financial under the Fair Credit Reporting Act authorizing us to obtain consumer reports about you from consumer reporting agencies, which we may do at the time you apply for a loan or periodically throughout the term of your loan. You authorize Payment 1 Financial to use the consumer reports to, among other things, authenticate your identity, make credit decisions and decisions related to the servicing and collection of your account, market refinancing and other products to you, measure how the loan you obtained from Payment 1 Financial impacts your credit, and/or for other related purposes or analysis. You also authorize Payment 1 Financial to verify information in your application, and you agree that Payment 1 Financial may contact third parties to verify any such information.
Fair and Accurate Credit Transactions Act Notice: We may report information about your account to credit bureaus. Late payments, missed payments, or other defaults on your account may be reflected in your credit report.
